1. Acceptance of Terms

By accessing or using Our Caring Circle, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must not use our Service.

2. Eligibility

You must be at least 13 years of age to create an account and use Our Caring Circle. By creating an account, you represent and warrant that you meet this age requirement. If you are between 13 and 18 years of age, you represent that you have your parent or legal guardian's permission to use the Service.

Note: While care recipients (people being cared for) may be of any age, all user accounts must belong to individuals who are at least 13 years old. Care recipient profiles are created and managed by adult circle members.

3. Description of Service

Our Caring Circle is a caregiving coordination platform that helps families organize and manage care for their loved ones. The Service includes task management, appointment scheduling, member coordination, calendar integration, activity logging, and related features designed to support collaborative caregiving.

4. Health Information Disclaimer (HIPAA)

Our Caring Circle is intended to help families coordinate who is helping with what, schedule appointments, and stay organized. Appointment notes are designed for caregiving logistics (transportation, parking, check-in procedures) only. It is not a substitute for medical record-keeping systems or healthcare provider portals.

5. User Accounts

When you create an account, you agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

6. Billing and Subscriptions

Our Caring Circle offers free and paid subscription tiers:

• Free tier: Basic features with limited capacity
• Paid tiers: Additional features and capacity, billed monthly or annually through our payment processor

Paid subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through the account settings or the billing management portal. Refunds are handled in accordance with our refund policy and applicable law. Downgrading your tier may result in loss of access to premium features and reduced capacity limits.

7. Acceptable Use

You agree not to use Our Caring Circle to:

• Violate any applicable laws or regulations
• Store Protected Health Information (PHI) or sensitive medical records
• Harass, abuse, or harm other users
• Upload malicious content or attempt to compromise system security
• Use the Service for purposes other than legitimate caregiving coordination
• Share access credentials with unauthorized individuals
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to access data belonging to other users or caring circles without authorization

8. Account Deletion and Data Handling

You may delete your account at any time through your account settings or by contacting us. Upon account deletion:

• Your personal data will be deleted or anonymized within 30 days
• Active subscriptions will be cancelled
• You will be removed from all caring circles
• Shared data (completed tasks, activity history) will be anonymized to preserve circle continuity for other members
• Certain data may be retained as required by law (e.g., billing records for tax compliance)

You may request an export of your personal data before deleting your account. See our Privacy Policy for details on data retention and your privacy rights.

9. Intellectual Property

The Our Caring Circle Service, including its design, features, and content (excluding user-generated content), is owned by Our Caring Circle and protected by intellectual property laws. You retain ownership of content you create within the platform. By using our Service, you grant us a limited license to use your content solely to provide and improve the Service.

10. Disclaimer of Warranties

Our Caring Circle is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. Our Caring Circle is not a medical service and does not provide medical advice.

11. Limitation of Liability

To the maximum extent permitted by law, Our Caring Circle and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination by us, your right to use the Service ceases immediately. We will provide notice of termination and the reason, except where prohibited by law or where your account poses an immediate security risk. Data handling upon termination follows the same process described in Section 8.

13. Privacy Rights and Non-Discrimination

We respect your privacy rights under all applicable laws, including CCPA, CPRA, GDPR, and COPPA. You will not be discriminated against for exercising your privacy rights. Specifically:

• We will not deny you the Service for exercising privacy rights
• We will not charge different prices or rates for exercising privacy rights
• We will not provide a different level or quality of service for exercising privacy rights

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of our Service shall be resolved in the state or federal courts located in Oklahoma County, Oklahoma.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page, updating the "Last updated" date, and for significant changes, notifying you via email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
